Clarification of 7.30 Trees section of the proposed covenants

We have recently received several questions regarding Trees on home owner's properties.  The following is our response.

In response to the questions about “7.30 Trees”, the board has been communicating via e-mail to double-check each one of our interpretations of this language. We all agree that this should have been written more clearly.  Our interpretation of the phrase “preserved and maintained” is that this means not only trimming/pruning but also includes removal of trees that are overgrown, unhealthy, too close to a house or creating other potential for damaging the property, or part of a new landscape design. In our view, removing selected trees from your lot will not conflict with 7.30.

Our annual meeting is next Tuesday and we have already begun to receive ballots containing the votes of some of the homeowners in The Crossings.  Changing the language in the amendments now would require us to distribute the changes to everyone and begin the voting process again.
