Proposed HOA Covenants – Update and Executive Summary

Residents of the Crossings Neighborhood,

We have received several questions about the proposed covenants that will be voted on at our annual meeting on April 30th.  As always, the proposed covenants are provided at:

Voting Process

All residents should have received the ballot in the mail along with the self-addressed, stamped envelope.  All return envelopes have been coded with each resident’s lot number inside the envelope.  This will help us understand who voted. It will not be used to record how residents voted.  All ballots will be opened at the annual meeting on April 30th.  Someone will be chosen to open the envelope and place the empty envelope in one box and then the ballot in the other box.  Ballots will then be counted. No one will know how each resident voted.

The current covenants require that the amendment process needs two-thirds (100 homes) approval votes for passage. The Board worked for nearly a year on the development of the proposed amended covenants. We want to see the process completed in a valid election that produces either 100 “yes” votes, or 51 “no” votes. We do not want the result to be a non-decision on this important topic because there was not a sufficient number of total votes to approve or reject.

In prior years, votes for nominees running for election to Board positions often totaled far less than 100 votes. For this reason, it was decided that a way to identify those who did not vote might be needed for follow up contacts with them in order to get their votes.

Executive Summary of Proposed Covenants

  • The current covenants were written with rules that govern constructing a new development and building new houses.  Many of these covenants were retained in the Proposed Covenants.
  • The proposed covenants provides methods for future boards to formalize the process to deal with violations
    • Establishing procedures for residents to bring complaints for any violations
    • Establishing methods for resolving complaints with residents
    • Establishing procedures to utilize fines for residents who refuse to remedy violations or who simply choose to ignore the covenants.

The Proposed Covenants ARE NOT MEANT to:

  • Be unreasonably burdensome on any resident.
  • Dictate the aesthetics of any house.
  • Provide Additional Revenue for the HOA.
